Father of Hossein Ronaghi handed 4-month prison sentence in absentia

Hossein Ronaghi Ahmad RonaghiAhmad Ronaghi Maleki, father of political prisoner Hossein Ronaghi has been sentenced to 4 months in prison for sharing information about his son’s illness and his situation in prison.

According to the Kaleme website, Branch 116 of the Tabriz Public (criminal) Court charged Hossein Ronaghi’s father with publishing lies in cyberspace and sentenced him to 4 months in prison based on Article 698 of the Islamic Penal Code and Article 19 of the Islamic Penal Code which was adopted in 2013. The court session for Ahmad Ronaghi was conducted in absentia without his knowledge, or presence of a lawyer on his behalf.

The Tabriz Public Court operating out of its legal jurisdiction, issued the indictment based on claimed evidence provided by the Intelligence Office of East Azerbaijan Province. The Code of Criminal Procedure stipulates that interrogations must be done in the presence of the accused and the resulting documents must be signed. If the accused is illiterate, a trusted witness must sign.

Ahmad Ronaghi Maleki, whose son has confronted various illnesses as a direct result of his incarceration, is himself suffering from degenerative eye disease rendering him almost blind in one eye while the other eye has fifty percent vision. He also suffers from heart disease and has undergone surgery several times.

During the past 6 years since the arrest and imprisonment of his son, Ahmad Ronaghi Maleki has been summoned to the Tabriz Court numerous times and subjected to high-pressure interrogations in attempts to have him sign false confessions. Hossein Ronaghi’s family is constantly harassed and threatened by the Tabriz Intelligence Agency for publicizing information about the deteriorating health and situation of their incarcerated son. His brother Hassan Ronaghi has received threats to remain silent and his mother was once served with a warrant for talking about her son. His mother Zoleikha Mousavi who continues to speak out about her son despite the threats, recently shared that authorities told her the family’s efforts on behalf their son’s freedom would be futile.

In an interview with Rooz on July 6, a day after Ahmad Ronaghi was served his prison sentence, Zoleikha Mousavi said that even if her husband is taken away, the family will not remain quiet. Hossein Ronaghi’s mother said in the Rooz interview that authorities are aware that according to Article 134 of the Islamic Penal Code it is unlawful to return her son to prison. She said Hossein Ronaghi’s sentence should be terminated if the judiciary conforms to what is stipulated in this penal code. She added that because of his situation, Hossein Ronaghi has a pardon from the Supreme Leader. She said the IRGC and Intelligence offices told them they are not opposed to releasing her son, yet it seems Hossein Ronaghi is being held due to a personal agenda.

Zoleikha Mousavi said that they were given 10 days to follow up on the court order for her husband. Hossein Ronaghi’s mother stressed that the family has been subjected to unceasing threats to not conduct interviews during the years but they will not back down. For his birthday, Amnesty International, which has declared Hossein Ronaghi a Prisoner Of Conscience, launched an Urgent Action Campaign demanding that he not be returned to prison. Journalism Is Not A Crime was also among international human rights groups asking that the ailing blogger not be returned to prison.

According to reports by CHRR, Hossein Ronaghi Maleki, jailed blogger and human rights activist was violently arrested at his home in the city of Malekan near Tabriz on December 13, 2009 during the mass unrest following the contested presidential elections. At the time he used the penname Babak Khorramdin and worked with Iran Proxy, a group that worked towards combating Internet censorship in Iran. His brother Hassan Ronaghi Maleki was also arrested and held in solitary confinement where he was subjected to severe torture to add duress and demoralize his brother. He was released on bail after one month and suffers permanent damage to his neck and spine from the torture. Hossein Ronaghi was held for 13 months in Evin prison’s Ward 2-A [under control of IRGC] where he endured severe physical torture and psychological pressure in an effort to coerce an interview and false televised confession, which he refused. Eventually Branch 26 of the Revolutionary Court sentenced him to 15 years in prison.

While he was in perfect health when he was arrested, Ronaghi’s health has rapidly deteriorated throughout the years as a result of the torture, substandard prison conditions in Evin prison and lack of medical attention behind bars. He has endured 4 kidney operations and countless transfers to the hospital and back to prison during this time. The activist has embarked on several hunger strikes behind bars in protest of his situation along with that of other political prisoners. Despite the recommendation by the Official Forensic Office to release Hossein Ronaghi on medical grounds, he has been ordered back to prison after a short furlough. On July 5, 2015, Hossein Ronaghi’s 30th birthday, agents went to his family home and delivered the prison sentence for Ahmad Ronaghi Maleki – issued by a court session that was conducted without their knowledge.

Zoleikha Mousavi, mother of Hossein Ronaghi Maleki shared the following message for Norouz:

As long as I’m alive I will not have a moment of peace. The day my son was kidnapped from me, my heart was penetrated with the weight of all the pain in the world. This is the 6th year I spend the New Year without the presence of my son Hossein.

Six years have gone by and every year I ask God how I can handle this sorrow and pain.

Only a mother can grasp how I feel these days.

But know that maintaining honor is the reward for speaking of principles, and our children shall remain honorable.

I wish a happy New Year to all Iranians, specially the suffering mothers, the prisoners, and their families.

Letter by Hossein Ronaghi’s father to Ayatollah Khamenei

In a letter to the leadership, the father of Hossein Ronaghi expressed his concern regarding the attack in Ward 350 at Evin prison and said the lives of political prisoners including that of  his son are in danger.

According to the letter provided to Kaleme, Ronaghi’s father requested that the Supreme Leader follow-up and prosecute the perpetrators of the vicious prison beatings because the judiciary is under his control.

In the last 2 days many families of political prisoners have expressed their grave concern for the health and lives of their loved ones beaten in prison.

Following is the letter as provided to Kaleme:

Honorable Ayatollah Khamenei,

Supreme Leader of the Islamic Republic of Iran,

With greetings,

With respect I share with the leader of the Islamic Revolution that per recent reports on April 17th, plainclothes officials and Evin prison guards brutally attacked prisoners and many detainees have been severely wounded.

The evidence suggests that the lives of political prisoners including that of my son are in danger. During the past years political prisoners and their families have been abused and mistreated; if this type of inhumane and illegal behavior is tolerated in this country, then none of the citizens are safe.

With consideration to the fact that the judiciary is under your control, I respectfully ask that you order a swift investigation into this incident, announce the perpetrators and bring them to justice.

Letter by Hossein Ronaghi’s father to Tehran Prosecutor

Committee of Human Rights Reporters – In a letter to the Tehran Prosecutor, Hossein Ronaghi’s father divulges that a judicial office administrator has personally taken action to prevent medical furlough for the jailed activist.

In his letter Ahmad Ronaghi Maleki disclosed that an individual by the name of Sattari who is the Director of the office of Branch 26 of the Tehran Revolutionary Court is standing in the way of legal furlough for Hossein Ronaghi. Pursuant to Sattari’s actions, Branch One of the Revolutionary Court denied medical leave for Hossein Ronaghi with disregard to the information provided in Ronaghi’s submitted medical records.

Following is the letter by Ahmad Ronaghi to the Tehran Prosecutor as provided to CHRR:

 
In the name of God

Honorable Mr. Jafari Dolatabadi, Tehran Prosecutor General of the Public Court,

Pursuant to the letters provided by the Legal Medical Organization and the Tehran Shahrak-e Gharb Medical Commission regarding the kidney disease of Hossein Ronaghi Maleki, I request my son’s legal right per criminal law to be released.

Honorable Prosecutor, the Legal Medical Organization has sent its findings to the Prosecutor’s office.

Honorable Prosecutor, due to the absence of the presiding judge at Branch 26 of the Revolutionary Court, my son’s case was transferred to Branch 1 presided by Judge Ahmadzadeh. However with the direct influence and meddling of Mr. Sattari – office Director of Branch 26 of the Revolutionary Court – on February 5th without even reviewing my son’s provided medical records, Judge Ahmadzadeh presiding over Branch 1 of the Revolutionary Court denied medical furlough. As stipulated by the law, this action on the part of the presiding judge was illegal.

Honorable Prosecutor, I hereby request that medical furlough be granted for my son seyed Hossein Ronaghi Maleki, who is a political prisoner in failing health.

Hossein Ronaghi’s father sustained injuries from car accident

Seyed Ahmad Ronaghi Maleki, father of Hossein Ronaghi got into a car accident while visiting Tehran from his home in Azerbaijan and unfortunately sustained injuries to his body including a broken nose and dislocated shoulder.

This distressed father spends all his days getting in touch with the Tehran Prosecutor’s office, the revolutionary courts and various judicial institutions in an effort to follow up on the court files and get any update on the situation of his jailed son. However so far his efforts have been futile as his ailing son languishes behind bars in Evin prison.

Seyed Ahmad Ronaghi Maleki left the hospital despite his injuries and doctor’s orders to be hospitalized. He is now in Tehran continuing his follow up work for his jailed son’s affairs.


Ahmad Ronaghi Maleki summoned to court

Committee of Human Rights Reporters – Seyed Ahmad Ronaghi, father of jailed activist Hossein Ronaghi Maleki was summoned today to present himself at court in Tabriz.

According to news provided to CHRR, per the summons order, Seyed Ahmad Ronaghi must present himself in 3 days at Branch 8 of the Tabriz court presided by the Deputy Prosecutor, and answer questions relating to the court files stemming from his volunteer activities when he went to the aid of victims in the earthquake stricken area of Azerbaijan.

Ahmad Ronaghi Maleki was among a group of citizen volunteers who were detained at Sarand relief camp in Azerbaijan on August 22, 2012 as they were administering help to the earthquake victims in the area. Hossein Ronaghi Maleki and his brother Hasan Ronaghi Maleki were among the detained group. Branch 1 of the Tabriz Revolutionary court presided by Judge Hamlbar later handed prison sentences to 20 of the volunteers on the charge of “assembly and collusion with the intent to harm national security.”

Hossein Ronaghi Maleki was handed a 2.5 year prison sentence which raised his total prison term to 17.5 years. He is now spending his prison term behind bars in Evin prison despite being very sick and in need of immediate medical attention.

Ahmad Ronaghi Maleki was previously summoned in January 2013 and charged with “insulting and defaming the judiciary of East Azerbaijan Province.” Seyed Ahmad Ronaghi Maleki who has never engaged in any political activities donated personal money to the earthquake victims and now must face charges brought against him for helping his countrymen.

Conditional release of Ahmad Ronaghi Maleki and a second summons to appear at the Tabriz Prosecutor’s Office

Committee of Human Rights Reporters – Ahmad Ronaghi Maleki who had been summoned to the East Azerbaijan Prosecutor’s Office Wednesday January 16, 2012, was granted conditional release after being detained for several hours.

Ahmad Ronaghi Maleki is the father of Hossein Ronaghi Maleki who is a political prisoner on furlough and one of the Sarand Camp earthquake volunteers who was arrested at the campsite and sentenced to an additional prison term.

According to news obtained by CHRR from reliable sources, following his appearance per his summons at the East Azerbaijan Prosecutor’s office at 8am January 16, Ahmad Ronaghi Maleki was charged with “insulting and defaming the judiciary of East Azerbaijan Province.” Initially his family was told to return the next day to follow up on his case, however Ahmad Ronaghi Maleki was released later in the day (January 16th) with a summons to come back on Saturday January 19th to undergo interrogations.

The group of earthquake relief volunteers was arrested in September at Sarand camp as they were administering aid to the earthquake victims. Tabriz judicial authorities today also accused the group that was sentenced to a total of 19 years in prison, of drinking homemade alcohol, use of illegal satellite equipment, and non-religious mix of the opposite sexes. Ahmad Ronaghi Maleki was told that his physical ailment would not prevent him from being arrested.
